Welcome to Clock iT Speed. These Terms of Service ("Terms") govern your access to and use of clockitspeed.com and the game it hosts (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Acceptance of Terms
By accessing or playing Clock iT Speed, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. These Terms form a binding agreement between you and the operators of Clock iT Speed.
Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms on your behalf.
Description of the Service
Clock iT Speed is a free, browser-based hand-speed challenge. The game uses your device's camera to detect thumb-and-finger pinches during a 20-second window and posts your score to a public leaderboard. Features include a daily leaderboard, score sharing, and links to a separate product called Check Dat Number.
Camera and Device Permissions
The Service requires access to your device's camera in order to function. As described in our Privacy Policy, the camera feed is processed locally on your device and is not transmitted to us or any third party. You may revoke camera access at any time through your browser settings, but doing so will prevent the game from working.
User Conduct
You agree not to:
- Use automated tools, bots, scripts, hardware modifications, or any other means to artificially inflate scores, submit fraudulent leaderboard entries, or otherwise circumvent the intended gameplay.
- Submit leaderboard names that are obscene, hateful, harassing, threatening, defamatory, impersonate another person, infringe trademarks, or are otherwise unlawful.
- Attempt to gain unauthorized access to the Service, its servers, or any systems connected to it.
- Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures.
- Interfere with the Service's operation, overload it with requests, or attempt to disrupt other users.
- Reverse engineer, decompile, or attempt to extract source code from the Service except to the extent permitted by applicable law.
- Use the Service to violate any applicable law or regulation.
Leaderboard Moderation
We reserve the right, at our sole discretion and without notice, to remove any leaderboard entry, reset scores, ban devices or IP addresses, or take any other action we consider necessary to maintain the integrity of the leaderboard or comply with these Terms. We are not obligated to explain moderation decisions.
Intellectual Property
The Service, including the Clock iT Speed name, logo, mascot character, artwork, code, copy, sound, and design, is owned by us or our licensors and is protected by copyright, trademark, and other laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial entertainment.
You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service, except that you may share links to the Service and your own scores on social media.
User-Submitted Content
By submitting a leaderboard name, score, or any other content to the Service, you grant us a worldwide, royalty-free, non-exclusive license to display, store, reproduce, and distribute that content as part of operating the Service. You represent that you have the right to submit the content and that it does not violate these Terms or any third party's rights.
Third-Party Services and Links
The Service displays advertisements served by Google AdSense and contains links to third-party sites, including but not limited to Check Dat Number. We do not control and are not responsible for the content, policies, products, or practices of any third party. Your use of any third-party service is at your own risk and subject to that party's terms and privacy policy.
Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that the Service will meet your requirements, that leaderboard scores will be accurate or preserved, that camera-based hand tracking will perform to any particular standard, or that defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law, in no event shall the operators of Clock iT Speed, their affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or relating to the Service shall not exceed one hundred U.S. dollars ($100), or the amount you paid us in the twelve months preceding the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless the operators of Clock iT Speed and their affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third party's rights.
Modifications to the Service
We may add, change, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be highlighted on the Service. Continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the Service.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. You and we agree that any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
